Terms of Use.
The rules for using CommExcellence, the Commercial Scorecard, research, Commercial Signal, advertising features, AI assisted tools and the CXC platform credit system.

CommExcellence does not presently charge South African VAT as a VAT registered vendor. If its VAT status changes, the website, checkout information and applicable legal terms will be updated.
Using the platform means accepting these terms.
By accessing or using CommExcellence, you agree to use the website and its features lawfully, honestly and in a way that does not interfere with security, availability, other users or third party rights.
If you use CommExcellence on behalf of an organisation, you are responsible for ensuring you have authority to submit information and to agree to any terms relevant to that use.
A diagnostic, not a guarantee.
The Commercial Scorecard is a self assessment and decision support tool. Scores, dimension results, reports, recommendations and comparisons depend on the answers supplied, the scoring methodology and the information available at the time.
Scorecard outputs are not a certification, audit, assurance opinion, market valuation or professional advice. They do not guarantee revenue, margin, cash, performance or any other commercial outcome.
You remain responsible for checking the relevance of the output, obtaining professional advice where required and making final decisions.
Evidence first, with limitations visible.
CommExcellence research may use aggregated or de identified Scorecard responses and other voluntarily provided context to identify recurring commercial patterns. Research results may change as the sample grows, segmentation improves or methodology is refined.
A small or unrepresentative sample should not be treated as a market benchmark. Published research should disclose enough context, including sample size and material limitations, for readers to interpret the findings responsibly.
You must not attempt to re identify participants from published or shared aggregate research data.
Independent editorial content and clearly labelled partnerships.
Commercial Signal provides analysis, commentary, research and practical commercial information. Editorial judgement remains with CommExcellence. Content may include opinion and may be corrected or updated as evidence changes.
Sponsored, partner or paid placements should be clearly labelled. Payment does not buy a research result, Scorecard finding, editorial conclusion or undisclosed endorsement.
Commercial Signal is general information and does not replace legal, tax, accounting, investment, engineering, employment or other regulated professional advice.
An enquiry is not a contract and reach is not invented.
Submitting an advertising or partnership enquiry does not create a contract, reservation, exclusivity right or guaranteed placement. A commercial relationship becomes binding only when the parties agree the applicable terms in writing.
Unless a written agreement says otherwise, CommExcellence does not guarantee impressions, audience size, traffic, leads, conversions, sales or other campaign outcomes. Audience and research claims should be based on available evidence rather than invented projections.
Partners are responsible for ensuring that supplied claims, creative assets, trademarks, offers and landing pages are lawful, accurate, substantiated and do not infringe third party rights. CommExcellence may reject, pause or remove a placement that conflicts with editorial independence, law, reader trust or platform standards.
Earned platform credit. Crypto-funded advertiser credit.
CXC is a CommExcellence platform credit with a fixed internal reference value of USD 1 per CXC. Users may earn CXC through qualifying participation. Advertisers and approved organisations may purchase CXC using supported crypto assets only: BTC, ETH, XRP, RLUSD and USDT, subject to the network shown at checkout.
CXC itself is not cryptocurrency, is not blockchain based, is not legal tender, is not transferable and does not expire through the passage of time. Eligible unused purchased CXC may be refunded in the same crypto asset used to buy it using the exchange value when the refund is processed.
CXC can be redeemed for eligible advertising, Commercial Signal or research access, future tools and other platform services expressly priced in CXC. Full rules are contained in the CXC Terms.
Use access features responsibly.
Publication access links, tokens or other credentials are for the authorised user and may not be sold, shared at scale, bypassed or used to defeat access controls.
Comments and contributions must be lawful, relevant and respectful. You must not submit unlawful, defamatory, threatening, deceptive, infringing, confidential or malicious content. CommExcellence may moderate, refuse or remove content and may preserve records where necessary for security or legal reasons.
Where you voluntarily submit content for publication, you grant CommExcellence a non exclusive licence to host, display, reproduce and moderate that content for the purpose of operating the relevant feature, subject to applicable privacy rights.
Useful assistance can still be wrong.
AI assisted features such as Astrobot may generate responses from automated systems. Outputs can be incomplete, outdated or inaccurate and should be checked before being relied on.
Do not submit confidential, privileged, sensitive or regulated information to an AI feature unless the feature specifically asks for it and the disclosure is lawful and appropriate.
CommExcellence content remains protected.
CommExcellence retains rights in its name, branding, site design, written analysis, research materials, Scorecard methodology and structure, reports, graphics, software and original content except where third party rights apply.
You may link to public pages and use reasonable extracts for ordinary reference with attribution. You may not scrape at scale, reproduce substantial protected content, clone the Scorecard, remove rights notices, train a commercial dataset from protected content or commercialise CommExcellence material without permission or another lawful basis.
Do not attack, manipulate or misrepresent the platform.
- Do not bypass security or access controls, introduce malware, overload the service or probe systems without permission.
- Do not create fake Scorecard submissions, automated participation, false research responses or activity intended to manipulate sample counts, CXC, reputation or published metrics.
- Do not impersonate another person or organisation or falsely imply sponsorship, approval, affiliation or endorsement.
- Do not use the platform to violate privacy, intellectual property, consumer protection, cybercrime or other applicable law.
The platform can change.
Features, content, methodologies, routes and availability may be changed, improved, suspended or discontinued. Reasonable efforts are made to maintain the service, but uninterrupted or error free operation is not guaranteed.
To the maximum extent permitted by law, CommExcellence is not responsible for indirect or consequential loss arising solely from reliance on general website content or inability to access the service. Nothing in these terms excludes consumer rights, statutory remedies or liability that cannot lawfully be excluded.
Third party websites, tools and services remain subject to their own terms and privacy practices.
South African law applies.
These terms are governed by the laws of the Republic of South Africa, including mandatory rights that may apply under the Electronic Communications and Transactions Act, Consumer Protection Act, POPIA and other applicable law.
Electronic communications may be used for notices, confirmations and service messages where lawful. A message is not necessarily received merely because it was sent, and users should follow up where a response is important.
These terms may be updated when the platform or law changes. Material changes will be reflected by an updated date and may require separate acceptance where appropriate.
